Jury must focus 'on the state of Mrs Dickason’s mind at the time'


The essential question of insanity in this trial was if because of the disease of her mind, Dickason did not know what she was doing was morally wrong, the judge said.

“This element of the defence would be satisfied if the defence has proved on the balance of probabilities that, because of the disease of her mind, Mrs Dickason did not know what she was doing was morally wrong at the time she killed the children.

“Your focus must be on the state of Mrs Dickason’s mind at the time and whether she appreciated that what she was doing was wrong.”
